Page Numbering Sequence
Page Numbering: Page numbers appear in the lower right hand corner of the pages. Pages are numbered sequentially. When a new page is added between existing pages, a decimal is added to the preceding page number. For example, a new page added between pages 5 and 6 would be numbered 5.1.
Page Revision Numbers: Revision numbers appear in the lower right hand corner of the pages. These numbers are used to determine the most recent version on file with the Commission. For example, the 4th Revised Page No. 4 cancels the 3rd Revised Page No. 4.

1.0 Scope of Common Carrier Authority:
1.1 Certificate No. 55903
Transportation of passengers in call-and-demand taxi service between all points in within a 50-mile radius of the intersection of Main Street and 5th Street in Walsenburg, Colorado.
2.0 Rules and Regulations
2.1 Applicability
The rules and regulations set forth in this section shall be applicable to the transportation performed and the rates and charges in this Tariff. This Tariff applies only to Colorado intrastate operations.
2.2 Passenger Service and Restrictions
Rides and Deliveries by Derek and Jamie reserves the right to refuse transportation to any person who, in the opinion of driver in charge of the transportation, is under the influence of alcohol or other drugs, is suffering from a contagious disease, is behaving in a manner considered to be offensive, or presents a risk to himself, herself, other passengers, third parties, or the driver. Such refusal shall not be based on religious, ethnic, or any other discriminatory characteristic prohibited by law.
No Smoking, or drinking alcohol is allowed in any Rides and Deliveries by Derek and Jamie vehicle.
2.3 Animal Restrictions
Except as allowed by this item, animals/pets shall not be transported. Only service animals traveling with their masters will be transported. Service animals shall be under the control of their masters at all times. Rides and Deliveries by Derek and Jamie will not be responsible for loss or injury to these animals, nor for an injury or damage to any person or property caused by the actions of these animals. Rides and Deliveries by Derek and Jamie reserves the right to hold passenger liable for paying a damage fee of $500.00 if such service animals cause damages to our vehicles.
2.4 Baggage Restrictions
Each passenger shall be allowed to transport two (2) pieces of normal sized baggage at no charge. Subject to space available, additional baggage may be accommodated for an additional charge.
One (1) purse and one (1) briefcase per passenger will not be counted as baggage. Identification and designation of “purse” and “briefcase” shall be left up to the discretion of the driver in charge of the transportation.
2.5 Explosives and Other Dangerous Articles
Rides and Deliveries by Derek and Jamie will not transport any articles or substances that, in the opinion of the driver in charge of transportation, are dangerous to the health and/or safety of any passenger or Rides and Deliveries by Derek and Jamie Taxi driver or employee. These articles or substances may include but not limited to explosives, toxic agents and hazardous materials, or any other illegal items, or firearms.
2.6 Inclement Weather and Road Conditions
Nothing in this tariff shall require Rides and Deliveries by Derek and Jamie to transport passengers or their baggage, if in the opinion of the driver in charge of transportation, weather, street, road, or highway conditions, either from the point of origin, destination, or points in between, render operation of the motor vehicle dangerous or impracticable.
2.7 Payment Types and Time of Collection
Payment for all fares and charges shall be in U.S. dollars in the form of cash, cashiers checks, business checks, or approved credit cards, with proper identification.
Payment is due at time of service unless prepayment was previously received.
Deposits made to reserve a transportation date and time shall be made in the amount of one half of the anticipated trip charge.
Receipts will be provided upon request.
2.8 Reservation, Cancellations, and Refunds
To receive a full refund of a prepaid reserved transportation service, the passenger must submit a request to Rides and Deliveries by Derek and Jamie to cancel the previously reserved transportation service by U. S. mail, e-mail, or by telephone, at least 24 hours in advance of the reserved transportation date and time.
If the cancellation request is received by Rides and Deliveries by Derek and Jamie less than 24 hours before the reserved transportation date and time, the passenger will be charged a cancellation fee equal to 50% of the payment for the transportation service.
If the cancellation request is received by Rides and Deliveries by Derek and Jamie after the reserved transportation date and time, the passenger will be charged a cancellation fee equal to 100% of the payment for the transportation service.
If a passenger has requested taxi service and is not at the agreed upon pick-up location at the agreed upon pick-up/departure time, no refund will be issued.
2.9 Complaints
Passengers may submit complaints to Rides and Deliveries by Derek and Jamie by U. S. mail, e-mail, or by telephone. Staff of Rides and Deliveries by Derek and Jamie will make an effort to resolve the complaint fairly. If the complainant is not satisfied, he/she may contact the PUC at:

2.10 Claims
Claims for lost, damaged or destroyed articles must be submitted to Rides and Deliveries by Derek and Jamie by U. S. mail, e-mail, or by telephone within seven (7) days of the completion of the transportation during which the damage or loss occurred.
2.11 Liability
Except due to the negligence of the staff of Rides and Deliveries by Derek and Jamie, including the driver in charge of the transportation service, Rides and Deliveries by Derek and Jamie shall not be responsible for a passenger’s lost, stolen, damaged or destroyed baggage or other personal property. Liability for negligence by the staff of Rides and Deliveries by Derek and Jamie is limited to $ 150.00 per piece of baggage/property, and then only when the baggage/property has been loaded in the vehicle by the driver.
Rides and Deliveries by Derek and Jamie will not be liable or responsible for damage to property or injury to passengers that result from the acts of passengers or other third parties.
Rides and Deliveries by Derek and Jamie accepts no responsibility for cancellations or delays in transportation which are beyond its control, including but not limited to weather, traffic or road conditions.
2.12 Commissions
Rides and Deliveries by Derek and Jamie may pay commissions to travel agents, transportation brokers or other businesses with which it has agreements regarding such commissions.
2.13 Multiple Loading
Multiple loading is the sharing of a taxicab ride/trip, or portion thereof, by individuals or parties who are not travelling together.
Multiple loading of passengers is prohibited except in cases in which the first passenger engaging the taxi approves such multiple loading.
Parties traveling from a common point of origin to a common point of destination will be charged as a single party.
When parties compromising a multiple load are dropped at different locations, each passenger or party of a multiple load shall pay the normal, shortest route fare, from the point of origin to their destination point except for any applicable fare reduction listed in the charges and rates section of this tariff. Said reduction shall not apply to charges for extra passengers or other extra services.
3.0 Rates and Charges
3.1 Charges
Any charge incurred by Rides and Deliveries by Derek and Jamie or its drivers in their provision of transportation services including but not limited to road tolls, bridge tolls, use fees, admission/gate fees and parking fees, airport fees shall be added to the passenger’s fare.

3.2 Taxi Rates and Fares
$5.00 one direction in town $7.00 one direction Spanish Peaks hospital $2.00 each additional stop
Each additional passenger free the fare for service that originates more than 10 miles but less than 50 miles from the intersection of Main Street and 5th Street is $10.00 and $2.00 per loaded mile.
